Burden of Proof
The burden of proof lies with the person who asserts.
Burden of proof (burden of proof, Beweislast (German)) refers to the risk or disadvantage borne by one party in litigation when, if the existence or non-existence of a fact in issue is not established, the fact is treated as non-existent and a legal judgment is issued accordingly. It is also called the burden of proof or the onus of proof.
