Luhmann's Social Systems Theory

There is no empirical basis for why humans deserve respect more than dogs. Therefore, when analyzing society, we should analyze 'communication' and 'systems' rather than humans.
- Economic communication
- Artistic communication
- Political communication

A social system is composed of such communications. Human rights are institutions that allow everyone to participate in and communicate within various systems, and they are a historical product of the modern era.

However, after the modern era, "individuals" free from hierarchical systems emerged.

Since the modern era, functional differentiation has taken place.

The concept of human rights is the all-access pass that enables this kind of functional communication.

But even when participation is guaranteed, actual individuals cannot participate.
Secondary exclusion causes an amplification effect.
Once excluded from economic communication, one is excluded from other systems such as education, politics, or artistic communication.
Because the effects of this secondary exclusion do not divide borders, the further globalization progresses, the more massive the exclusion becomes.
The root cause is not a problem of individuals or companies, but social structures that block substantive social participation.
=> What is Luhmann's solution to the human rights problem? Establishing institutions.
